1. GENERAL REQUIREMENTS

Certified Technician Required

A certified technician is required for assembly, prep, basic care & maintenance, and all technical issues to maintain warranty coverage.

Age Requirement

By purchasing any item from NTX Power Sports, you acknowledge and agree that you are above 18 years of age.

2. WARRANTY

Standard 30-Day Parts Warranty

Your purchase includes a 30-day warranty for defective parts only.

NOT Covered:

• Labor or mechanic costs
• Accidents, abuse, or neglect
• Minor dents and scratches
• Returns
• Outbound and inbound shipping costs

Manufacturer Warranty

All products and parts are covered by a manufacturer warranty facilitated through NTX Power Sports. Warranty terms vary by manufacturer. Contact us at ntxpowersports01@gmail.com for details.

In addition, NTX Power Sports offers a free 1-year warranty on the engine.

Warranty Exclusions:

• Wheels (tires and rims)
• Clutches
• Lubricants
• Gaskets
• Unauthorized and/or unlicensed repair/assembly
• Standard wear and tear: Batteries, body parts, brakes, spark plugs, throttle grips, hoses, fuel lines, brake lines, filters, brake & clutch levers, light bulbs, seats & upholstery
• External (non-NTX Power Sports authorized) repair labor costs, downtime, towing, or shipping charges

Warranty is Void if:

• Extreme riding, racing, or competition riding
• Vandalism or theft
• Fire
• Accident (at fault or not at fault)

Extended Warranty

The extended warranty works the same as the manufacturer warranty and applies from the date of delivery through the end of the extended warranty period. It covers the engine and parts with the same exclusions listed above.

3. REFUNDS & RETURNS

No Refunds Policy

There are absolutely no refunds for any items or used items, regardless of damage or performance. All sales are FINAL.

If help is needed, technical support and replacement parts are available.

Returns Policy

Returns are accepted within 30 days of deliveryonly and must meet the following conditions:

• Items must be unused and in new condition
• Items must remain in the original crate/box as received
• All returns require a valid RMA (Return Merchandise Authorization) number

Returns without an RMA will be refused and sent back to the customer

Return Costs:

• Customer is responsible for return shipping (original shipping is non-refundable)
• A 20% restocking fee applies
• Freight collect and COD packages will not be accepted

Cancellations

• You can cancel and receive a full refund within 24 hours of placing your order or until your order has shipped (whichever is greater)
• Once shipped, a 20% restocking fee plus return shipping costs ($150–$350 depending on location and item weight) will apply
• Cancellations cannot be accepted after the item has been processed and shipped

Contact us immediately to initiate a cancellation or return. Refunds will be processed once the item is received at our warehouse or we confirm it has not shipped. Allow up to 10 business days for refund processing.

4. PRODUCT ASSEMBLY

Most products require some assembly.

Important:

• If you choose to assemble your unit yourself, you accept all liability and void your warranty
• To maintain warranty coverage, you must have a licensed mechanic assemble your unit
• Save the receipt or paperwork proving the work was carried out by a licensed mechanic
• Do not operate the machine until it has been completely inspected by a certified mechanic

NTX Power Sports offers assembled units but under no circumstances takes responsibility for the safety of the product.

5. SHIPPING POLICY

Processing & Transit Times

• Orders are typically processed and shipped within 3 business days
• You will receive a tracking number within 3 business days of shipment
• We use third-party LTL carriers for vehicles and UPS or USPS for parts/accessories
• LTL transit time: 2–10 business days (depending on your distance from the nearest distribution center)
• Holiday seasons may add 3–5 business days
• Orders cannot be canceled or refused due to extended transit schedules

Free Shipping

Free shipping is offered on some units and applies to most destinations in the continental US.

Not Included:

• HI, AK, US territories, or international destinations
• Some remote areas in the continental US
• Manhattan and islands accessible only by boat or airplane are common exceptions

Shipping Surcharges

We occasionally incur excessive shipping charges to outlying states in the northeast, southeast, and northwest. We will notify you prior to shipping if additional charges apply.

Address Verification

If your shipping address differs from your billing address, we will require billing address verification, which may delay your order.

Delivery Refusal Policy

Shipments cannot be refused for delivery under any circumstance. 

If you refuse delivery:

• You will be responsible for shipping costs
• A 20% restocking fee will apply

Shipping Damage or Missing Items

If you receive damaged or missing items, you must notify us within 2 business days by filing a claim on our website.

• For minor issues, we will ship replacement parts
• For major damage, we will arrange pickup of the damaged unit and delivery of a replacement

Lost Shipments

If you do not receive your item within 14 days and have had no contact from NTX Power Sports regarding delays, contact us so we can track and resolve the issue.

Non-Shipment Refund Policy

If your item does not ship within 14 business days (excluding time awaiting customer information), you can request a full refund and cancel your order.

No Returns After Use

Once a product has been assembled, fueled, or used in any way, it cannot be returned for any reason.

6. PRICING & PRODUCT INFORMATION

Price Match Guarantee

We will match any competitor's price if:

• The competitor offer is proven in writing (via letter or current web page)
• The price match includes shipping
• The offer is from a licensed dealer
• The product is in stock
• The competitor offer is not a sale or promotional price
• The offer does not violate manufacturer minimum advertised price
• Price match must occur before the sale is made
• Price match will not be honored for value packs or free promotional items

Changes & Inaccuracies

NTX Power Sports constantly improves our website and strives for accurate product information. However:

• Sometimes we receive inaccurate information from manufacturers
• If you are concerned about a product description, contact us before purchasing
• Prices are subject to change
• No refunds or reimbursements if prices change after you place your order
• We are not responsible for typographical, technical, or descriptive errors
• We reserve the right to cancel any order for any reason, including pricing errors

Item Colors

We offer two color choices when ordering in case your first choice is out of stock. If both choices are unavailable, we will contact you to discuss options.

7. SPECIAL VEHICLE CONDITIONS

Refurbished or Clearance Vehicles

Vehicles sold as "Refurbished" or on "Clearance" are sold "as is" without warranty (express or implied).

• The buyer is responsible for satisfying themselves about the vehicle's condition
• All defects and repairs are the sole responsibility of the buyer
• NTX Power Sports assumes no liability in connection with the sale
• Manufacturer warranties (if applicable) are not affected
• Refurbished/Clearance vehicles do not qualify for additional discounts, promotions, or free products

Year of Manufacture

Foreign vehicle identification numbers (VINs) may be one or two years behind the US calendar.

• If VIN year is critical to your purchase, notify us before purchasing
• NTX Power Sports will not issue refunds or accept returns due to year of manufacture

8. LEGAL & COMPLIANCE

State Laws on Motor Vehicles

You are responsible for checking your state's laws regarding vehicle emission regulations and compliance before making a purchase.

Vehicle Registration

Any on-road motor vehicle must be tagged, titled, and registered. Refer to your state laws for compliance and procedures. An MCO (Manufacturer's Certificate of Origin) may be required for on-road registration.

Credit Card Chargebacks

Once a product has shipped, you agree to waive your right to charge back your credit card under any circumstance. All issues must be handled in accordance with our policies.

• Riding any vehicle (including motorcycles, mopeds, and go-karts) purchased from NTX Power Sports can be a dangerous activity requiring skill
• These activities can result in serious injury or property damage
• You voluntarily assume all risk associated with loss, damage, or injury while riding

Release of Liability

You agree to release and forever discharge NTX Power Sports, its parent company, agents, employees, officers, directors, trustees, manufacturers, and all entities acting on their behalf from:

• Any and all claims, actions, damages, liabilities, costs, expenses, and attorney fees
• Related to your use of these vehicles or equipment
• Whether or not caused by the negligence of the seller, manufacturer, or distributor

Waiver of Rights

By this agreement, you surrender and waive your rights to:

• Sue NTX Power Sports or its representatives
• Exercise any legal rights to seek damages

This agreement is binding upon heirs, agents, personal representatives, and assigns.

Final Acknowledgment

You are aware that by purchasing and remitting payment, you:

• Assume all risk
• Waive and release substantial legal rights
• Release all liability regarding activities with items purchased from NTX Power Sports

12. BREACH OF CONTRACT

These Terms and Conditions serve as a final and binding agreement between NTX Power Sports and you (the user/buyer).

In the event of a breach initiated by you, you agree to pay any costs associated with:

• Collection of payment due
• Removal of harassing, abusive, defamatory, threatening, hateful, offensive, obscene, or indecent statements or images about NTX Power Sports, its products, or employees
• Including but not limited to: collection fees, attorney costs, court costs, and associated costs

Legal Venue:

As NTX Power Sports is principally owned and located in Dallas, Dallas County, Texas, legal venue will be enforced within the boundary lines of Dallas County, Texas.
